Is borrower of money from financial institution a consumer under the provisions of consumer protection act,1986 as amended up to date.

I have filed an application under Order 9 Rule 4 CPC before the Consumer Forum to recall the order dated 5.5.2005 after noticing that the respondent obtained such an order by playing fraud upon the Forum. The respondent contested in his objection that Order 9 Rule 4 CPC is not applicable in the instant case. Therefore before the commencement of arguments that is posted next week, I would like to amend the application from Order 9 Rule 4 CPC to Section 151,152 and 153 CPC. How this can be done. Please guide.
